The fiftieth session of the ECOWAS Councif of Ministers was held at the Executive Secretariat Headquarters in Abuja on 26 and 27 June 2003. 2. In his addres~, the Chairman of the Council of Ministers, Dr. Kofi Konadu Apraku, Honourable Minister of the Republic of Ghana for Regional Cooperation and NEPAD, welcomed the members of Council and their respective delegations. The Honourable Minister pointed out the importance of starting meetings punctually, in order to avoid wasting precious time, and expressed the hope that at this session, Council would adopt the appropriate measures to ensure progress in the integration of the West African region. OUTCOME OF DELIBERATIONS Item 2: Presentation and Consideration of the Interim Report of the Executive Secretary 8. The ECOWAS Executive Secretary, Dr. Mohamed Ibn Chambas presented his 2003 interim report on the Community to the Council of Ministers. The report analysed the economic situation in the region, outlining its development prospects, focusing on the impact of the Ivorian crisis on the regional economy. The report pointed out that because of the strategic importance of Cote d'lvoire, the political instability which began in 1999, and the armed conflict which has held the country in thrall since 19 September 2002, have had severe economic and financial repercussions on the rest of the West African sub-region. As a result of the conflict some countries are struggling to come to grips with difficulties in obtaining supplies, declining trade, overpricing, falling revenue, capital drain and disruption of business. Macroeconomic performance which was never particularly good, has worsened during the crisis. 9. Nonetheless, the Executive Secretary pointed out that there are grounds for cautious optimism with regard to the political and economic prospects for Cote d'lvoire, Page 3 ~ . Repor! of the 50th Session of the Council of Ministers following the implementation of certain provisions of the Linas Marcoussis Agreement ;; and the different decisions of the ECOWAS Heads of State and Government on the resolution of the Ivorian crisis. 10. The chapter on the functioning of the Community began with an overview of progress accomplished since the beginning of 2003. The chapter reported the implementation status of the different decisions of the Heads of State and Government. with a special emphasis on the free movement of persons, monetary cooperation. cooperation in trade as exemplified by the organisation of the 3rd ECOWAS trade fair, cooperation in matters relating to Customs, production, infrastructure and human development. In addition, significant progress has been made in the implementation of the West African power pool and gas pipeline projects. as well as telecommunications projects during the period under review. 11. In the section on administration and finance, the Executive Secretary reported on the restructuring of the Secretariat, with reference to staff recruitments and staff accommodation, and reminded Council of the extremely precarious financial situation of the Secretariat. He pointed out that only 33%) of contributions to the budget of the Secretariat was received in the first semester, as compared to the expected 50%. 12. Addressing the issues of peace and security, the Executive Secretary reviewed the situation in Sierra Leone, Liberia, Cote d'lvoire and Guinea Bissau. 13. His report described the efforts of ECOWAS to redress the situation in Liberia and Cote d'lvoire, and find a lasting solution to the crises bedevilling the two countries. He expressed particular satisfaction at recent progress in the search for a permanent solution to the Ivorian crisis, informing Council that ECOWAS was also making intense efforts to put an end to the Liberian civil war. 14. Council commended the Executive Secretary on the quality of his report, which was adopted after discussion, with the following observations and recommendations: Page 4 :; - Repoft of the 50th Session of the Council of Ministers Implementation of ECOWAS Priority Programmes .. i) Council·reiterated the decision taken at its 49th session in Dakar from 25 to 28 January 2003 by which the Secretariat was directed to submit a comprehensive progress report on the implementation of protocols and decisions, especially those on the trade liberalisation scheme and the Community Levy. The meeting requested that the report should identify all the obstacles to the implementation of this programme and propose solutions for consideration at an extraordinary session of Council scheduled to take place from 29 August to 2nd September 2003. The Republic of Benin has agreed to host this session. ii) Council stressed the need for speedy action on the creation of the ECOWAS free trade zone and customs union. Member States were urged to desist from creating tariff and non-tariff barriers, especially trade barriers, to other Member States of the Community. Council directed the Secretariat to draw up a detailed action plan for the establishment of the ECOWAS common market. iii) On the monetary cooperation programme, Council appealed to the Member States of the 2nd monetary zone (WAMZ) to redouble their efforts to meet the macro-economic convergence criteria, guided by the principles of good governance, through public finance reforms and the introduction of the appropriate structural reform measures. iv) Council expressed concern at the extremely precarious financial position of the Community arising from the huge arrears of contributions to the budgets of its institutions. This situation is unlikely to facilitate implementation of Community programmes. The meeting therefore mandated the Chairman of Council and the Executive Secretary to undertake missions to all the Member States which have difficulty in implementing fully the provisions on the Protocol on the Community Levy with a view to resolving these difficulties. Page 5 .; - Report of the 50th Session of the Council of Ministers v} Council requested the Executive Secretariat to speed up the mobilisation of external-resources to complement the internal resources needed to finance Community programmes. vi) Council urged the Secretariat to establish priorities when drawing up its programmes, taking into account the mandate and objectives of the Community. vii} Council requested the Secretariat to improve on the procedure for the recruitment of consultants by extending its search to all the ECOWAS Member States, and according preference to Community citizens. viii) Council also urged the Executive Secretariat to involve the civil society, NGOs and cultural associations in ECOWAS activities in order to enable them to contribute to the development of a sense of ECOWAS citizenship. ix) Council expressed satisfaction at the improvement of the situation in Cote d'lvoire and the resumption of some economic activities. It called on all the political stakeholders to renew their efforts to consolidate the peace process. x) Council appealed to all the parties in the Liberian conflict to abide by the ECOWAS decisions in order to arrive at a lasting solution to the political instability. Item 3: Consideration of the Report of the ad hoc Ministerial Committee on the Selection and Evaluation of Statutory Appointees 15. The report of the ad hoc Ministerial Committee on the Selection and Evaluation of Statutory officers primarily concerns the selection of a candidate to the post of Financial Controller, which was allocated to the Republic of The Gambia by the Authority of Heads of State and Government. The committee conducted the interviews of the three candidates proposed by The Gambia, and recommended the appointment of Mrs. NeJlie Sarah Taylor, who obtained the highest score, to the post of Financial Controller. 17. Council adopted the recommendation of the committee and appointed Mrs. Nellie Sarah Taylor to the post of Financial Controller. 18. Council also advised that the Executive Secretariat should reconsider the scoring method to ensure a healthy balance between the marks for the curriculum vitae (CV) and those for the interview. Item 4: Consideration of the Report of the Meeting of the ad hoc Ministerial Committee on the Harmonisation of Community Texts 19. The rapporteur for the meeting of the ad hoc Ministerial Committee on the Harmonisation of Community Texts presented the report of the first meeting of the committee which was held in Accra on 19 June 2003. 20. In compliance with the terms of reference set out in Regulation C/REG.15/01/03 dated 28 January 2003, the ministerial meeting, which was preceded by a meeting of experts from the Member States, analysed the shortcomings of the revised Treaty and ECOWAS Protocols which could hinder the integration process. It also examined the disparities in the Community texts relating to the administrative and management procedures adopted by the Community Institutions. 21. The ad hoc ministerial committee agreed on the need to improve the revised Treaty and some of the Protocols by amending some of their provisions and harmonising some of the texts, with a view to ensuring respect of the ECOWAS spirit in all the Community institutions and the just and equitable treatment of all their staff. 22. The committee therefore recommended the adoption of a new legal framework for Community acts and a more appropriate time-frame for the entry into force of some Community acts. It also recommended that measures should be taken to facilitate the Page 7 L ~ - • ! \ Report of the 50th Session of the Council of Ministers .. conclusion of cooperation agreements between ECOWAS and third countries and between ECOWAS and other international organisations. 23. The committee recommended the expansion of the powers of the Court of Justice, direct access to the Court by individuals, the adoption of measures to ensure effective implementation of decisions of the Court of Justice, the alignment of the English and French versions of ECOWAS texts, and the review of some of the references in certain texts in order to bring them in line with the relevant provisions of the Treaty. 24. The ad hoc ministerial committee also formulated recommendations on the composition of the Joint Advisory Committee on staff recruitment, the procedures for fixing the salaries of the Secretary General and the Deputy Secretary General of the Community Parliament, the need to evaluate the statutory appointees, the need to ensure conformity of the relevant texts of all the institutions with Community budgetary procedure, and the need to apply the decision on the scheme of service to staff recruitment. 25. Finally, the ad hoc ministerial committee recommended that Council should authorise the Heads of institution to promote deserving serving officers and also authorise the Executive Secretary to recruit a lawyer specialising in the drafting of legal texts. 26. Council adopted the report of the ad hoc ministerial committee and requested the Executive Secretariat to align the English and French versions of the report. 27. It also requested the Executive Secretariat to take urgent measures to amend the revised Treaty and Protocols, as recommended by the ad hoc ministerial committee. Page 8 · -- Item Slil: Repori of the 50th Session of the Council of Ministers Consideration of the Report of the Administration and Finance Commission 28. The report of the twenty-ninth meeting of the Administration and Finance Commission held at Abuja on 23 and 24 June 2003, was presented by a member of the Nigerian delegation. 29. The report addressed the following issues:- Status report on the professional staff housing estate at Katampe; Status report on the feasibility studies on the housing estate for locally recruited staff; Status report on the computerisation of the Executive Secretariat; Consideration of the report of the Trade, Customs, Taxation, Statistics. Money and Payments Commission; Presentation on the ECOWAS workshop on civil society; ECOWAS capacity building within the framework of NEPAD; Status report on the Community levy; Posting of representatives of the Executive Secretary to Member States; Meetings of technical commissions. 30. Following deliberations, Council adopted the report and made the following observations and recommendations: (i) The Executive Secretariat was authorised to commence the additional works listed in annexes I and II attached to the report, while a meeting of Page 9 - .... .. - .. . . Report of the 50th Session of the Council of Ministers the ad hoc Ministerial Committee on the Construction of Headquarters of CommunitY Institutions should be convened on 21 and 22 July 2003, to examine the estimates contained in Annexes III and IV. The report of the meeting should be submitted directly to the Chairman of Council for consideration and approval; ii) On the proposed housing scheme for locally recruited staff, the Executive Secretariat should continue to work with the consultant to finalise his report, taking into account the observations made on the draft report. In the meantime, the Executive Secretariat should approach relevant mortgage institutions, including the Nigerian National Housing Fund, to explore the possibility of registering interested G and M Staff in their various housing schemes. Any housing project financed by the Community remains its exclusive property; (iii) The Executive Secretariat should endeavour to adhere to the time-frame indicated in the action plan for the computerisation exercise; (iv) As regards the ECOWAS workshop on civil society, the Executive Secretariat should prepare an in-depth document and present it to the Security and Defence Commission. Also, a register of civil society groups should be compiled, while the Community should take more concrete steps to strengthen such groups in the sub-region; (v) Concerning the ECOWAS capacity building initiative within the framework of N EPAD, the Executive Secretariat should be very clear about its mandate to monitor and facilitate the implementation of NEPAD in West Africa. In that regard, the duties assigned to the consultants to be recruited should be clearly defined, while the imposition of donor ideas and programmes on the Community should be avoided. There should be emphasis on the recruitment of regional conSUltants while adequate attention should be given to staff training and the channelling of resources obtained into programme implementation; Page 10 . ..... . - . . # . - (vi) Report of the 50th Session of the Council of Ministers The Executive Secretariat should endeavour to convene meetings of those tech~ical commissions which have been dormant over the year. Item 5 (iil: Consideration of the Report of the 45th Meeting of the Trade. Customs. Taxation. Statistics. Money and Payments Commission 31. The Chairman of the commission presented the report of the meeting which had deliberated on the following: i) new products and industrial enterprises submitted for approval to benefit under the ECOWAS trade liberalisation scheme; ii) implementation of Articles 7 and 8 of Regulation C/REG.3/4/02 on approval procedure for the registration of enterprises and the assignment of an approval number to a product; iii) continued existence of obstacles to intra-Community trade in goods approved to benefit under the ECOWAS trade liberalisation scheme; iv) payment due to Member States as compensation for loss of revenue; v) interpretation of article 7 of Protocol AlP1/1/03 defining the concept of "originating product"; vi) introduction of the new certificate of origin: 32. Council adopted the report and recommendations of the commission, particularly those calling on Member States where obstacles to the free movement of goods persist, to take all necessary measures to eliminate such obstacles as: prohibition on imports of products approved under the trade liberalisation scheme; administrative obstacles (requirement of prior authorisation) to the importation of approved products: Page 11 - "lo .. - .. , W· absence of directives at the national level to ensure implementation of the trade liberalisation scheme. 33. Council approved the list of 220 products and 62 enterprises recommended by the Commission to benefit under the ECOWAS Trade Liberalisation Scheme. The relevant Council Regulation is annexed to this report. 34. Council also decided to examine the problems arising in connection with the implementation of the: trade liberalisation scheme at its extraordinary session in Cotonou, from 29 August to 2 September 2003. Council agreed that the extraordinary session would also be used to evaluate the implementation of the Community Levy as well as reflect on the 28 years of the existence of ECOWAS with a view to appraising its performance. Item 6: Status Report on the Community Levy 35. The Executive Secretariat submitted a memorandum presenting the statement of financial contributions from the Member States and identifying the obstacles to the application of the Community levy, and proposing recommendations for their removal. The most serious of such obstacles are arrears of contributions, and the case of Member States with non-convertible currencies. 36. Council directed the Executive Secretariat to prepare a detailed memorandum on the issue for consideration at its extraordinary session in Cotonou from 29 August to 2 September 2003. Item 7: Any Other Business Modalities for NEPAD implementation in West Africa 37. Council recalled that the ECOWAS Heads of State and Government met in Yamoussoukro in May 2002, to work out modalities for the implementation of NEPAD in the West African region. One of the decisions of the summit was on the creation of an ad hoc ministerial committee to assist the Secretariat in the implementation of the NEPAD action plan. - . ~ " Report of the 50th Session of the Council of Ministers 38. Council directed the Executive Secretariat to prepare a detailed report on the status of implementation~ofthe NEPAD Plan of Action adopted in Yamoussoukro. The report should present the progress made, difficulties encountered in the implementation of NEPAD including proposals on the way forward. The said report is to be presented to a technical committee meeting. Council directed that a sense of urgency should be injected into matters relating to the implementation of NEPAD Action Plan. 39. Council commended the Executive Secretary and his colleagues on the quality of the reports presented, and urged them to re-double their efforts to realise the ideals of the Community. Item 8: Adoption of Report 40. The report of the meeting was adopted. Item 9: Closing Ceremony 41. The Chairman of Council, Dr. Kofi Konadu Apraku expressed his appreciation to his fellow-Ministers for their diligence during the consideration of the issues submitted to Council. He urged all Member States to make more serious efforts to ensure the implementation of ECOWAS decisions. 42. Council heartily commended Dr. Kofi Apraku for his skilfql conduct of the business of the meeting, and expressed their appreciation of his untiring efforts to ensure the success of the Community. 43. The Chairman announced that the Executive Secretariat had received nine (9) instruments of ratification of the ECOWAS Bank for Investment and Development (EBID) Protocol which therefore entered into force on 24 June 2003. The nine (9) Member States that have ratified the Protocol are: Benin, Cote d'lvoire, Ghana, Guinea, Mali, Niger, Nigeria, Senegal and Toga. He appealed to the other Member States to ensure the ratification of the protocol without further delay while the instruments should be forwarded to the Executive Secretariat. Council adopted a motion commending the Chairman of the Authority of Heads of State and Government, His Excellency President John Agyekum Kufuor of the Republic of Ghana and the ECOWAS Executive Secretary. Or Mohamed Ibn Chambas for their untiring efforts in the promotion of peace and security in the West African region. Council also commended in particular. the on-going efforts on the crisis in the Republics of Liberia and Sierra Leone. 45. On behalf of the Institutions of ECOWAS. the Executive Secretary thanked the Chairman for his efficient conduct of the Session of Council. He also expressed appreciation to all the Council members and assured them of the Executive Secretariat's determination to implement the decisions taken at this session. Article 3 Member States and the Executive Secretariat shall take all Ilecessary measures to ensure the implementation of this decision. Article 4 This regulation shall be published in the Official Journal of the Community by the Executive Secretariat within thirty (30) days after Signature by the Chairman of the Council of Ministers. Wishing to endow the ECOWAS institutions with the means necessary to the successful conduct of their mission and the enhancement of their performance, and to this end providing them with an adequate number of qualified and competent staff; Considering that Mr. Momodu Yandey Malleh Sallah, apPointed as Financial Controller to the ECOWAS institutions by virtue of Regulation C/REG 5/8/02, dated 28 August 2002 has been called to other duties and has therefore been unable to take up service in ECOWAS; Mindful of article 18 of the Treaty on the appointment of statutory a ppoi ntees; Having considered the report of the ministerial committee for the selection and evaluation of statutory appointees which met in Abuja on 25 June 2003; -. . -2- ENACTS Article 1 Madam Nellie Sarah TAYLOR is hereby apPointed Financial Controller of the institutions of the Economic Community of West African States for a term of four years. Article 2 The apPointment of Madam Nellie Sarah TAYLOR takes effect from the date of her assumption of duty. Article 3 This Regulation shall be published in the Official Journal of the Community within thirty days of its signature by the Chairman of the Council of Ministers. Abuja 26 - 27 June 2003 Regulation C/REGS/6/03 Amending Articles 2 and 3 of Regulation C/REG15/1/03, dated 28 January 2003 The Council of Ministers, Mindful of articles 10, 11 and 12 of the Treaty establishing the Council of Ministers and defining its composition and functions; Mindful of Regulation C/REG14/01/03 establishing an ad hoc mir isterial committee on the harmonisation of Community texts; Considering that Article 2 of Regulation C/REG15/01/03 contains an omission in its definition of the competence of the ad hoc ministerial committee on the harmonisation of the Community texts and that Article 3 of the same Regulation contains an error in the composition of the committee; Desirous of correcting the omission and the error; On the recommendation of the ad hoc ministerial committee on the harmonisation of Community texts which met in Accra on 19 June 2003; ENACTS Article 1 Article 2 paragraph 3 of Regulation C/REG15/01/03, dated 28 January 2003 is hereby amended and henceforth reads as follows: • I ., -2- New .Article 2 (3) The committee shall submit recommendation to the Authority of Heads of State and Government, through the Council of Ministers, on the enhancement of the powers of the ECOVVAS Parliament, the election of ; lembers of said Parliament by direct universal suffrage, and the place of the Parliament among the other Community institutions. Article 3 The Togolese Republic is a member of the ad hoc Committee in place of the Republic of Sierra Leone. Article 4 This Regulation shall be published in the Official Journal of the Community within thirty days of its Signature by the Chairman of the Council of Ministers.
